Court Denies Stay In Hopkins County

MADISONVILLE, Ky. (AP) - A judge has denied an injunction to prevent a western Kentucky smoking ban from being enforced.

The delay was sought by businessmen Thomas Richardson of Madisonville and James Haulk of Dawson Springs, who filed a lawsuit Oct. 6, claiming the smoking restrictions adopted by the county Board of Health were unconstitutional.

The Clean Indoor Air Regulation adopted by the Hopkins County Board of Health took effect Oct. 12, banning smoking in most enclosed public places.

The board will begin enforcing the ordinance after the 30-day grace period ends Wednesday.
