Will Cheryl McCafferty Testify Today?

As the murder trial of a Northern Kentucky woman continues into its second week, winter weather is causing some speculation over the possible next step.

The question at issue on Tuesday is whether an east coast snow storm will prevent one of the prosecution's key expert witnesses in the Cheryl McCafferty murder trial from getting to the Tri-State.  The witness is currently in Virginia, trying to find a flight as the area recovers from the storm. 

The trial is scheduled to resume at 10 Tuesday morning, but it is still unclear who will be next to testify.

One of the options to keep the trial moving could be for defense attorneys to begin calling their witnesses, including Cheryl McCafferty herself.

The 44-year-old Fort Thomas mother of two is accused of killing her husband, Robert, with a single gunshot to the head at their home on June 25, 2007.

On Monday, a pair of prosecution witnesses, who are experts in blood spatter, testified on Robert McCafferty's position at the time he died.  They said evidence shows he was lying down in bed and not moving much, if at all, when he was shot and killed.

Prosecutors contend Cheryl McCafferty shot her husband while he was asleep.

However, her attorneys say McCafferty shot her husband only after he started to move toward her in bed, after a night of violent arguments.

We should find out later on Tuesday whether jurors will get to hear from the defendant or if they'll have to wait. The trial is now in its second week.
