Final Appeals Made Over Proposed Mine

CINCINNATI -- Dust, noise, traffic and explosions. That's what some Anderson Township residents say can be expected if a limestone mine moves into the neighborhood.

Martin Marietta Materials, Inc. wants to operate an underground mine near Broadwell Road.

Anderson Township residents and officials in surrounding communities say the mine and increased truck traffic would bring down property values and pose a safety concern.

Attorneys representing both residents and the company made their final appeals to the township zoning board Monday night.

“Martin Marietta, according to the township zoning code, has the burden of proof to show that there are not going to be any nuisances created by this mine,” said Timothy Mara, attorney for opponents of the mine. “They have not, in our opinion, satisfied that requirement. And we think the law requires the board of zoning appeals to say no, go away.”

“They started off with a lot of fears and speculations which I think over the 16 months we've presented evidence that shows we meet all the standards of the code, and I think much of that stuff is unfounded,” said Richard Brahm, attorney for Martin Marietta.

Monday night was the last public hearing.

The final decision is up to the zoning board, but a timeline on the ruling is unclear.
