LONDON, Ky. - A man who says he was beaten in a rural state park because he is gay says he lied at first to the FBI about why he got into a pickup truck with his attackers.

The Lexington Herald-Leader says Kevin Pennington testified Thursday in federal court that he initially told the FBI he went along to buy pop and cigarettes but actually expected to buy drugs.

He said Anthony Jenkins and his cousin, Jason Jenkins, yelled slurs about his sexual orientation as they punched and kicked him at Kingdom Come State Park in April 2011.

Prosecutors say it's a first for charges under a section of federal law that makes it illegal to attack someone based on sexual orientation.

Defense attorneys have said the attack was for other reasons.
