Man acquitted in toddler's death

ASHLAND, Ky. - An eastern Kentucky jury has acquitted a man accused in the death of a 15-month-old girl.

Boyd County prosecutors had alleged that Brian Brewster was responsible for the death of Cally Erica Jobe on April 30, 2011. The child died at Charleston Area Medical Center in West Virginia of what authorities determined were head injuries from abuse.

The girl's mother testified during the trial that Brewster was watching her daughter while she ran errands, and when she returned the child was unresponsive. Brewster's attorney argued that the injuries were inflicted before the child was placed in his care.

Prosecutor David Justice told The Independent that he was disappointed with the verdict, but knew it would be difficult because the case was based on circumstantial evidence.
