FORT MITCHELL, Ky. - A Northern Kentucky business will be allowed to keep the tables and chairs it set up on the sidewalk along Dixie Highway in Fort Mitchell.

The owner of Kocanut Joe's Yogurt Shop says he didn't know the tables and chairs violated the zoning code for the area when he set them up.

Tuesday the Fort Mitchell Board of Adjustment ruled that the outdoor dining area can stay.

The city says it supports the efforts of the business owner.

"We're very behind what they're trying to do, we think its a great location where family and friends can come to enjoy what I've come to understand is a fantastic frozen yogurt," said Brian Houillion, Fort Mitchell City Administrator.
