N.Ky. Woman Run Over, Killed By Car

ELSMERE, Ky. -- The man arrested and charged with running over a Kentucky mother says he didn't mean to do it.

Elsmere police have charged 23-year-old Nikia Comer's ex-boyfriend, Clifford Gardenhire, with manslaughter.

Comer's family says they use to date and had a 2-year-old son together.

Comer's father, George Pleasant, says the two got into an argument Monday night at her Plymouth Lane home in Elsmere.

Gardenhire is heard on a 911 call saying it was an accident.

Gardenhire: "Man, I accidentally killed my baby mama."

911 Operator: OK. How'd you'd do that, sir?"

Gardenhire: "She jumped on my car and I was trying to get away and she flipped (inaudible) and I accidentally ran her over."

911 Operator: "OK."

Gardenhire: "I'm sitting right here and I'm not going nowhere. I'm not trying to run. It was an accident."

Pleasant says he is struggling to accept his daughter's death. He questions why Gardenhire showed up at his daughter's home when he had filed a protection order against her.

"Cliff showed up at her house and they got into an argument because he had took her cell phone. And, so evidently she trying to get her cell phone and she gets up on the car. And next thing I know he hit the break. She falls off the car and he runs over her," Pleasant said.

Pleasant says witnesses told him his daughter jumped on the car as she tried to retrieve her cell phone.

"She said the car was on me and then he ran and hit the gas and ran her over and she died instantly. It's murder. It's not manslaughter. It's murder," Pleasant said.

In Kentucky, a murder charge in general requires intent.

Murder carries a 20 to 50 year or life sentence.

Manslaughter is generally what's charged when the suspect is under intense emotional distress.

A person could be sentenced to a minimum of 10 years for manslaughter.

Gardenhire told the 911 operator he was sorry about what he called an accident saying he already knew Comer was dead.

"It wasn't supposed to happen like this. She jumped on my car and I didn't know," Gardenhire told the 911 operator.

Gardenhire is being held at the Kenton County jail on a $10,000 cash bond.

He's due back in court on December 15.
